Terms & Conditions
I. Scope of application
- The following General Terms and Conditions apply only to distance selling contracts between HOFFNUNG BERLIN, Markus Schroda, Monumentenstraße 33/34, 10892 Berlin, Phone: +49 30 7527440, E-mail: kontakt@hoffnung-berlin.de and its customers (consumers within the meaning of § 13 BGB or entrepreneurs within the meaning of § 14 BGB). If individual provisions expressly refer to consumers or only to entrepreneurs, they shall only apply to them.
- Deviating GTC shall only apply if they have been expressly recognised and confirmed by the seller.
- The contract language is German. Insofar as the law of the Federal Republic of Germany does not conflict with the mandatory law of the consumer's country of origin, the law of the Federal Republic of Germany shall apply.
II. Product description
- The product images serve to illustrate the goods on offer. The colours, size and quality of the image may be influenced by the screen quality and the settings made. Therefore, it is not the illustration but the product description that is decisive.
- HOFFNUNG BERLIN processes genuine leather which, as a natural product, has slight differences in colour and surface structure.
- Errors and misprints excepted.
III. Offer, conclusion and storage of the contract
- The offers on our website are binding. The customer's declaration of acceptance (order, purchase order) constitutes an effective purchase contract. If the order concerns a customised production/customisation (e.g. made-to-measure production, name embossing), the customer submits a binding offer with his order. In this case, the contract is only concluded upon HOFFNUNG BERLIN's express declaration of acceptance.
- The customer's order data is stored internally by HOFFNUNG BERLIN for the processing of the contract. However, they cannot be retrieved by the customer. The customer will receive a confirmation of the contract with the content of the contract within a reasonable period of time after the conclusion of the contract, at the latest with the delivery of the goods.
- The procedure for entering orders, making corrections and deletions is set out in the user instructions on the order platform. Entries can also be deleted at any time by closing and leaving the website.
IV. Delivery, payment

Unless other due dates or delivery times are specified or expressly agreed in the item description, the following shall apply:
Payment is due within 5 calendar days after conclusion of the contract. The following delivery times are calculated from the day after your payment instruction has been issued:
Delivery in Germany within 7 working days (Monday to Saturday)
Delivery within the EU excluding Germany: 14 working days
Delivery in the rest of Europe: 21 working days - Payment can be made by bank transfer, via Paypal or by credit card.

V. Prices, shipping costs
- All prices are quoted in euros (€), including statutory VAT.

The following shipping costs are added to the prices of the goods:
Within Germany: flat rate shipping costs € 6.50
Deliveries within the EU without Germany: flat-rate delivery charge of € 15.00
Deliveries worldwide outside the EU: flat-rate delivery charge of € 30.00 - Customs duties incurred for deliveries abroad must be added.
VI. Retention of title
All goods remain our property until full payment has been received. The customer is not authorised to dispose of the goods as an owner before this time.
VII. Warranty, guarantee, customer service
- The statutory warranty claims apply.
- HOFFNUNG BERLIN provides a warranty for a total of 10 years from the date of purchase against breakage or tearing of a leather strap, over and above the statutory warranty. In the event of a warranty claim, the leather strap will be replaced free of charge.
- Insofar as third party guarantee commitments are advertised for individual goods, the guarantee conditions can be found in the information in the product description and the respective link, via which you can call up the guarantee conditions of the guarantor, or in the enclosed guarantee declaration. Guarantee commitments apply in addition to the statutory warranty claims and do not restrict these.
- Warranty claims arising from contracts with entrepreneurs within the meaning of § 14 BGB expire after 1 year for new goods; they are excluded for used goods.

XI. Place of jurisdiction
For all claims arising from contracts with entrepreneurs within the meaning of § 14 BGB (German Civil Code), the exclusive place of jurisdiction is agreed to be the competent court at the registered office of the seller.
